This agreement is between you and Turn Byte LLC (“we”, “us”). It covers the Lunahra software — the website, the app, and anything we publish as part of it (the “Software”). By creating an account, or by using the Software without one, you accept it. If you do not accept it, do not use the Software.
Two companion documents sit alongside this one and are part of the same arrangement: the Terms of Use say how the service is run, and the Privacy Notice says what happens to your data. Where this agreement and the Terms of Use say different things about the same subject, the Terms of Use govern.
1. What you may do
We grant you a personal, worldwide, royalty-free, non-exclusive, non-transferable licence to use the Software, for as long as this agreement is in force. Specifically, you may:
- use it on as many of your own devices as you like;
- use it for your own household;
- keep your data locally, or in an account, as you prefer;
- export your own data, and share a read-only link to it with a rav or anyone else you choose;
- tell anyone about it and encourage them to use it — it is free, and it is meant to be passed on.
There is no fee, no subscription and no licence key. The Software is offered l’zikuy harabim.
2. What you may not do
- Sell, rent, sublicense or otherwise charge anyone for the Software, or present it as your own work.
- Remove or obscure any notice of authorship, ownership or the halachic disclaimer.
- Copy the Software in order to run a competing service, or extract its halachic calculations to do the same.
- Copy, modify, adapt or translate the Software or its code, create derivative works from it, or publish or distribute it, in whole or in part. The licence is to use the Software — not to copy it or to change it.
- Reverse-engineer, decompile or disassemble the Software, except to the extent the law expressly permits despite this restriction.
- Use it to reach another person’s data, to disrupt the service, to send automated traffic at it, or to break any law.
- Enter another person’s health details without their knowledge and consent.
3. Who owns what
The Software, its design, its text and its code remain ours. This licence gives you the right to use it; it does not transfer ownership of anything. It is a licence to use only: the Software and its code may not be copied, modified or redistributed, and all rights not expressly granted here are reserved.
Your data is yours. The dates you record, the settings you choose and the lists you write belong to you. We claim no ownership of them and no right to use them for any purpose other than running the Software for you, as set out in the Privacy Notice. You can export them or delete them at any time.
The halachic sources the Software draws on are not ours and are not claimed. Zmanim are computed with the open-source @hebcal/core library, under its own licence.
4. The Software is an aid, not a posek
This bears repeating in the licence itself, because it is the most important limit on what you are being given. The Software calculates and records. It does not rule. Every real shailah — a vesses kavua, a questionable kesem, an onset during bein hashmashos, anything touching pregnancy, nursing or illness — belongs with a rav, and where a calculation and a rav differ, the rav is right.
The shitos the Software follows are the ones you or your rav select in Settings. We take no position on which is correct.
5. No warranty
The Software is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that its calculations will match a printed luach or your rav’s reckoning. Keep your own record alongside it.
6. Limitation of liability
To the fullest extent the law allows, Turn Byte LLC is not liable for any indirect, incidental, special or consequential loss, or any loss arising from reliance on the Software. Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud — and where you are a consumer, nothing here removes rights your local law gives you.
7. Updates and changes
We may update the Software at any time. We may change this agreement; if we change its substance we will raise the version number, and you will be asked to accept the new version before continuing to use the Software with an account. Your acceptance — which version, and when — is recorded on your account. Continuing to use the Software after a change means you accept it.
8. Term and termination
This licence runs until it ends. You may end it at any time by deleting your account and ceasing to use the Software. We may suspend or end it if you breach section 2, or if we stop offering the Software. On termination the licence in section 1 ends; sections 3, 5, 6 and 9 survive. Your right to export or delete your data survives long enough for you to exercise it.
9. Governing law
Turn Byte LLC is a United States company and the Software is hosted in the European Union. Where you are a consumer you keep the protection of the mandatory law of your country of residence, including your right to bring proceedings there.
